New Labour Codes
The new labour codes are a set of regulations that consolidate 44 labour laws under 4 categories of codes, namely, Wage Code, Social Security Code, Occupational Safety, Health & Working Conditions Code, and the Industrial Relations Code. The objective of these codes is to replace 29 cumbersome laws and to encompass over 500 million organized and unorganized sector workers, which is 90% of the workforce that has been outside labour laws.
Central Acts and Rules
Central labour laws are the laws enacted by the central government of India to regulate various aspects of labour compliance, such as wages, social security, occupational safety and health, industrial disputes, trade unions, etc. These laws aim to protect the rights and interests of workers and employers, and to promote harmonious and productive industrial relations in the country.
State Acts and Rules
State labour laws are the laws enacted by the state governments of India to regulate various aspects of labour compliances within their respective jurisdictions, such as minimum wages, working hours, holidays, leave, maternity benefits, etc. These laws aim to protect the rights and interests of workers and employers in the state, and to promote harmonious and productive industrial relations in the state. The state labour laws may be either laws passed by the state legislatures for applicability in the respective states, or amendments to the central labour laws to make them applicable to the state. In cases where the central and state laws are inconsistent, the state law, assented by the President, will prevail. However, where the provisions of the Central Act and the State Act are fully inconsistent and are absolutely irreconcilable, the Central Act will prevail, and the State Act will become void in view of repugnancy.
